Terms of service

These Terms of Use (“Terms”) govern your access to the Got the kids holiday cover planner (“App”) and gotthekids.com (“Site”). By using the App or Site, you agree to these Terms. Our Privacy Policy explains how we process personal data.
1. Who may use Got the kids
The App is intended for parents and guardians coordinating UK school-holiday childcare with people they already trust — grandparents, sitters, childminders, and co-parents in amicable arrangements. It is not a court-ordered custody or co-parenting enforcement tool.
Where the law requires it, a parent or guardian must create the household account and should supervise use. You must not use the App or Site in any way that violates applicable law.
2. Licence to use the App
Subject to these Terms and payment where required, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for non-commercial family schedule coordination, in accordance with applicable app store rules.
You may not: copy the App except as permitted by law; reverse engineer or attempt to extract source code except where permitted; remove notices or proprietary marks; use the service to harm, harass, or mislead others; or scrape or bulk-export data except through features we expressly provide.
3. Accounts, beta, and purchases
During family beta, planning may be free while we learn with real households. Family & friends never pay to open share links or confirm blocks.
If you buy the App or a subscription through the Apple App Store or Google Play, their terms, payment systems, and refund rules also apply — we cannot process store refunds directly. Paid plans, when launched, will be described on our pricing page. Subscriptions renew automatically through the store until you cancel in your Apple or Google account settings.
Optional advertising may appear in the free parent app when paid plans launch; share links for family & friends remain ad-free. See our Privacy Policy.
4. UK consumer rights (digital content)
If you are a consumer in the United Kingdom, the App is digital content. Under the Consumer Rights Act 2015, digital content must be as described, of satisfactory quality, and fit for a particular purpose (where you tell us of that purpose before buying). If it is not, you may have statutory remedies including repair, replacement, a price reduction, or a refund in some circumstances. Nothing in these Terms affects those statutory rights.
5. App Store and Google Play
If you download from the Apple App Store, Apple's Media Services Terms and Conditions and usage rules also apply. If you download from Google Play, Google's store terms apply. Payment, billing, and refund requests for store purchases are handled by Apple or Google under their policies.

6. Share links for family & friends
Share links grant view access to scoped schedule slices for the person you share with. You are responsible for who receives links. Treat links as confidential. We are not responsible for schedules shared beyond your intended recipients.
7. Intellectual property
The App, Site, Got the kids branding, and software are protected by intellectual property laws. We grant only the rights expressly stated in these Terms. You retain ownership of schedule content you create. You grant us a licence to host and display your content solely to provide the service.
8. Planning tool — no guarantees
Got the kids provides schedule coordination tools. It does not guarantee that cover will happen on time, that every person will confirm, or any particular childcare outcome. It is not affiliated with local authorities, schools, or holiday clubs unless we say so in writing.
9. Not professional advice
The App and Site do not provide legal, medical, psychological, or safeguarding advice. For concerns about a child's health, welfare, or legal arrangements, speak to a qualified professional. You remain responsible for the safety and welfare of children in your care arrangements.
10. Limitation of liability
To the maximum extent permitted by applicable law (including UK consumer law where you are a consumer):
- The App and Site are provided “as is” without warranties of any kind except those that cannot be excluded by law.
- We are not liable for any indirect, consequential, or special loss, or for loss arising from missed cover or reliance on schedule information, except where the law does not allow that exclusion.
- Our total liability for claims arising from these Terms or the App or Site (other than liability that cannot be limited) will not exceed the total amount you paid for Got the kids in the 12 months immediately before you first told us about the claim. During free family beta, this cap is zero if you have not paid a fee in that period.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under English law.
11. Suspension and changes
We may modify the App, Site, or these Terms. We will give reasonable notice of material changes where possible. Continued use after notice of material changes may constitute acceptance. We may suspend or discontinue features where necessary for legal, security, or operational reasons. You may delete your account at any time.
12. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to non-excludable rights you may have as a consumer in your country of residence.
